WATER LAW:
John McClure represents clients with public and private water interests throughout the state, including the San Luis Valley. He has substantial experience in change of water right actions, water quantity and quality issues, plans of augmentation, groundwater management, and relating to an interstate compact. The clients include farmers, ditch companies, well owners, a conservancy district, agricultural processing facilities and a board of county commissioners.

REAL ESTATE:
Peter Eggleston has represented clients in the acquisition and sale of large and small developed and undeveloped properties in many areas of the state. These include properties for the client’s use or investment; properties acquired for development and farm and ranch properties. He has also assisted clients in the process of securing necessary approvals for property development, marketing and financing.

COOPERATIVE LAW:
John McClure represents cooperatives throughout Colorado, including agricultural cooperatives, with business transactions and regulatory compliance. Two paralegal compliance assistants provide client services in monitoring and assisting with Federal and State regulations and directives, including OSHA, DOT, and EPA and related agencies.

ESTATE AND TRUST PLANNING AND ADMINISTRATION:
Peter Eggleston has broad experience working with families to develop and implement plans and methods for the transition of assets from one generation to another with maintaining the family’s values, assets and businesses while minimizing costs and tax burdens. He also has extensive experience in charitable and planned giving techniques to maximize the benefits of charitable giving, as well as significant experience in estate and trust administration.

COMPLEX LITIGATION:
John McClure has experience in complex litigation in state and federal courts in Colorado and other states. He is able to settle a dispute before it goes to trial, but also has significant trial experience. Agribusiness cases include representation of farmers in herbicide drift actions, ground water contamination, and claims under the Perishable Agricultural Commodities Act. Business cases in Federal District Courts include successfully defending a breach of contract action in Florida, successfully defending a forklift manufacturer in a Colorado, which was cited in Matthew Bender, prosecuting a Colorado trade secrets action, and obtaining a $4,000,000 judgment in a Colorado Federal Bankruptcy Court arising out of an embezzlement claim of an elderly person. 

COMMERCIAL TRANSACTIONS:
The firm assists clients in commercial and business transactions including contract negotiations and the formation of business entities including corporations, cooperatives, partnerships, and limited liability companies.
